Terms of Service

1. Acceptance of Terms

By downloading, installing, subscribing to, or using CalGram ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the App. These Terms constitute a legally binding agreement between you and CalGram.

Your use of the App is also subject to Apple's Standard Licensed Application End User License Agreement ("EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. In the event of a conflict between these Terms and Apple's EULA, these Terms shall govern to the extent permitted by applicable law.

2. Eligibility

You must be at least 13 years of age to use CalGram. If you are between 13 and 18 years of age, you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the App, you represent and warrant that you meet these eligibility requirements.

3. Description of Service

CalGram is a nutritional tracking application that uses artificial intelligence to:

• Analyze food photographs to estimate nutritional content
• Process text descriptions of meals for nutritional analysis
• Scan product barcodes and retrieve nutritional data from public databases
• Provide AI-powered coaching and personalized dietary guidance
• Generate recipes based on nutritional needs and preferences
• Track weight, calories, macronutrients, micronutrients, and hydration over time

All features require an active subscription.

4. Not Medical Advice — Important Disclaimer

• Nutritional estimates provided by AI analysis are approximations and may not be fully accurate. Values are generated by artificial intelligence models, not laboratory analysis.
• The App is not a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider.
• You should always consult a physician, dietitian, or other qualified health professional before making dietary changes, particularly if you have diabetes, kidney disease, eating disorders, food allergies, are pregnant or nursing, or are taking medication.
• CalGram does not diagnose, treat, cure, or prevent any disease or medical condition.
• AI coaching responses are not medical advice and should not be treated as such.

By using the App, you acknowledge that CalGram bears no responsibility for health decisions made based on information provided by the App.

5. AI-Generated Content Accuracy

CalGram uses third-party artificial intelligence services to analyze food and generate nutritional estimates. You acknowledge that:

• AI analysis may produce inaccurate, incomplete, or inconsistent results
• Nutritional values are estimates, not precise measurements
• Food identification may be incorrect, particularly for mixed dishes or poor-quality photographs
• Barcode data is sourced from third-party public databases which may contain errors or outdated information
• AI coaching and recipe suggestions are generated content and may not be appropriate for your specific needs
• Health scores assigned to foods are AI-generated assessments, not clinical evaluations

You are responsible for verifying any nutritional information that is critical to your health or safety.

6. Subscriptions and Payments

CalGram requires a paid subscription to access app features.

• Payment: Payment is charged to your Apple ID account at confirmation of purchase.
• Auto-renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the end of the current period.
• Free trials: If a free trial is offered, any unused portion of the trial period will be forfeited when you purchase a subscription. At the end of the trial, your subscription will automatically begin and your Apple ID will be charged unless you cancel before the trial ends.
• Price changes: Subscription prices may change. You will be notified in advance, and continued use constitutes acceptance of the new price.
• Cancellation: You can manage and cancel subscriptions at any time in Settings → Apple ID → Subscriptions on your device. Cancellation takes effect at the end of the current billing period.
• Refunds: No refunds are provided for partial subscription periods. All refund requests must be directed to Apple, as they process all payments.

7. Acceptable Use

You agree to use the App only for its intended purpose of personal nutritional tracking. You shall not:

• Reverse-engineer, decompile, or extract the source code of the App
• Interfere with or disrupt the App's servers, APIs, or infrastructure
• Attempt to circumvent subscription requirements or rate limits
• Use the App for any unlawful, harmful, or commercial purpose without prior written consent
• Transmit harmful, offensive, or objectionable content through the App

8. User Content

Food photos, text descriptions, and data you submit ("User Content") are processed solely to deliver the service. By using the App, you grant CalGram a limited, non-exclusive license to process your User Content for this purpose only. We do not claim ownership of your User Content. Food photos are analyzed in real-time and are not permanently stored on our servers.

9. Intellectual Property

All content, design, user interface, code, AI integrations, branding, trademarks, and visual assets in CalGram are the exclusive property of CalGram and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, sublicense, or create derivative works of any part of the App.

10. Third-Party Services

CalGram relies on the following third-party services:

• OpenAI API — food analysis, coaching, and recipe generation
• Cloudflare Workers — API proxy layer
• Open Food Facts — barcode product and nutritional data
• Apple App Store / StoreKit — subscription billing and payment processing

CalGram is not responsible for the availability, accuracy, or practices of third-party services. Disruptions to these services may temporarily affect App functionality.

11. Service Availability

CalGram is provided "as available." We do not guarantee uninterrupted or error-free service. Features requiring an internet connection (photo scanning, AI coaching, recipe generation, barcode scanning) may be temporarily unavailable. Offline features (viewing your food log, settings, and previously logged data) remain accessible without connectivity.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• CalGram is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
• CalGram shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, personal injury, or health-related outcomes arising from your use of the App.
• CalGram's total aggregate liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
• CalGram does not warrant the accuracy or reliability of any nutritional information, AI-generated content, or coaching advice.

13. Indemnification

You agree to indemnify, defend, and hold harmless CalGram, its developers, officers, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any health-related decisions made based on information provided by the App.

14. Dispute Resolution

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in accordance with applicable arbitration rules, conducted on an individual basis and not as a class action.

You may opt out of the arbitration clause by sending written notice to [email protected] within 30 days of first using the App.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions.

16. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms. You may stop using the App by cancelling your subscription and deleting it from your device. Upon termination, Sections 4, 5, 12, 13, 14, and 15 shall survive.

17. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the App or by other means. Continued use after changes constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions remain in full force.

19. Entire Agreement

These Terms, together with our Privacy Policy and Apple's Standard EULA, constitute the entire agreement between you and CalGram regarding your use of the App.
